医师多点执业的法律问题分析 |

摘要:医师多点执业政策推行以来,引起了社会各界的广泛热议。虽然部分省市已经开展了相关的试点工作,但并没有取得实质性的突破与进展。究其原因在于医师多点执业过程中,存在着医疗机构人事制度的制约、社会保障难以解决以及医疗纠纷法律责任承担主体不明确等诸多问题。本文就医师多点执业的法律问题进行分析,建议医疗机构与医师签订协议确立双方权利义务,多点执业医疗机构分担医师相关的社会保障费用,并由收治患者的医疗机构承担相应的法律责任,最后建议修订《医师法》以逐步实现符合中国国情的多元化医师管理模式。 |

Abstract:The new policy of multiple-site physicians has attracted widespread attention since it was implemented. However, although some provinces have carried out pilot work, there has been no substantial breakthrough or progress. The reasons are related to restraints of the personnel system in medical institutions, and the social insurance of physicians and the vague responsibility subject in medical dispute. In this paper, we discuss related legal problems and make some suggestions, including establishing rights and obligations on both sides, sharing social security fees between different institutions, and taking legal responsibility by the institution treating patients. Finally, the Physician Act should be revised to establish a diversified management model that is suitable to Chinas conditions. |
